A New Report on Presidential Investigations in the Decay of Donald J. Biden: a Democratic Candidate Trying to Obstruct Officials from Recovering Classified Material
Unlike in Biden’s case, where the president consented to searches of his property and willingly spoke with investigators, Trump is accused of actively trying to obstruct officials from recovering classified material.
Trump is facing more than three dozen federal criminal charges after boxes of classified material were uncovered in unsecure locations at his Mar-a-Lago residence in Palm Beach, Fla. Trump and his associates have been indicted on federal charges, and have pleaded not guilty.
Democrats had hoped the investigation would wrap up quickly so it would not become an issue in the presidential campaign. The probe lasted more than a year, and the report comes as Biden looks to square off in the campaign against Donald Trump.
The report zeroes in on two buckets of classified material, the first one containing information on military and foreign policy in Afghanistan and the second one containing a notebook with notes about national security.
Biden’s decision to read notes that were nearly identical to Mark’s was not justified. But the evidence does not prove beyond a reasonable doubt that he intended to share classified information. The notebook passage that Mr. Biden read was classified, he told Zwonitzer. That makes us doubt whether Mr. Biden did not act in accordance with the law.
“These material were proof of the stand Mr. Biden took in what he regarded as among the most important decisions of his vice presidency,” the report says.
The Biden’s personal attorneys turned over the materials which were said to be related to his time as vice president. Federal agents then found a small number of additional classified documents in a search of Biden’s home in Wilmington, Del. Agents also searched Biden’s vacation home in Rehoboth Beach, Del., but did not turn up any sensitive materials.
A Justice Department special counsel has recommended no criminal charges be brought against President Biden in connection with the classified documents that were found at his Delaware home and a think-tank office in Washington, D.C.
“We conclude that no criminal charges are warranted in this matter,” the report says. The conclusion would not be different even if the DOJ policy allowed criminal charges against a sitting president.
The White House ” disagrees with a number of incorrect and inappropriate comments in the report,” but it did not specify what those were.
The report showed that Biden cooperated with the investigation, and that there was a common mistake when packing documents.
He angrily responded to Robert Hur’s description of a portion of his interview in which the special counsel said Biden appeared to not remember when his son died.
Asked by a reporter about the description of being “a well-meaning elderly man with a poor memory,” Biden said: “I’m well meaning and I’m an elderly man and I know what I’m doing.”
Biden said the president of Mexico was too, when asked about the current hostage negotiations with Israel and Hamas.
In recent days in off-camera events, Biden has thrice mixed up names of foreign leaders, calling French President Emmanuel Macron “Mitterrand” and former German Chancellor Angela Merkel “Helmut Kohl.” The former leaders of Germany and France were named Franois and Kohl.

At a sensitive time for the president, he is in a tight race with Donald Trump, his predecessor as president who is the front- runner for the Republican nomination; his job approval remains low, as does his handling of the economy and immigration. The special counsel’s assertion that he’s an “elderly man with a poor memory” is hardly going to help.
In a press conference Thursday night, Biden argued that he was fit for office and that he cooperated with the investigation.
It covers what materials were discovered, what information was known and what legal arguments were made around whether the charges were appropriate.
The year his son Beau died of cancer, Biden used his notebook to write his memoir, Promise Me, Dad.
In conversations with his ghostwriter for the book, he read from those notebooks — and on at least three occasions shared classified material while doing so.
It would be very difficult to prove that Biden intended to break the law, according to Hur.
The characterization of Biden’s memory in the public report, and the letter to the special counsel that is attached to it, has Biden’s lawyers upset.
“The report uses highly prejudicial language to describe a commonplace occurrence among witnesses: a lack of recall of years-old events,” said Richard Sauber, special counsel to the president, and Bob Bauer, Biden’s personal counsel.
The lawyers note that the hours of interviewing with Biden began the day after the attack on Israel by Hamas.
“How in the hell dare he raise that?” Biden said it was irrelevant, and he was so emotional he couldn’t speak. I didn’t need anyone to remind me when he died.
Donald Trump, who is likely to face Biden in the November election, immediately made a point of saying Biden should not be president.

Trump, meanwhile, is awaiting trial in multiple cases, including for the Mar-a-Lago documents case. In the hours before the Hur report dropped, the Supreme Court was considering whether Trump could be removed from the ballot in Colorado for his role in the Capitol attack.
