The Second Appointment of a House Speaker in the Senate and Implications for the Structure of the Constituent Assembly: The Case of Steve Scalise

The House’s successful impeachment vote comes a week after another failed vote on the measure. Three Republicans joined the Democratic caucus to block the attempt. The impeachment measure was able to be passed thanks to the return of Rep. Steve Scalise who had been gone for a long while to seek treatment for blood cancer. The effort fulfills a key promise made by House Republican lawmakers to their base voters and underscores the conference’s willingness to using their investigative and oversight powers to keep border security and immigration enforcement centerstage heading into the 2024 election season. The matter now heads to the Democratic-controlled Senate, where lawmakers are widely expected to acquit or otherwise sidestep the charges and allow Mayorkas to remain in his role.

The three Republicans who did the right thing again did so because one of them, Steve s Scalise of Louisiana, was absent last week.

The first impeachment of a cabinet officer in American history was passed by a single vote. (There were two absences on each side.) The Republican leaders had to make a last-minute decision on the vote because a Democrat could win the race and deny Republicans their majority in the House.

This impeachment was an utterly partisan and deeply dishonest act that debases the House’s role in the structure of the Constitution. It forever shatters a barrier that was considered sacred by previous Houses, which took their responsibility seriously and did not use impeachment for political purposes.

The Senate could very well dismiss this nonsensical act without a trial, and it should do so promptly. But an immediate dismissal would require a majority vote, and inevitably some nervous Democrats with tough elections ahead won’t want to be seen as supporting Mayorkas. There is a chance that the Senate Democrats will bury the resolution in a committee after the election.

“House Republicans will be remembered by history for trampling on the Constitution for political gain rather than working to solve the serious challenges at our border,” Ehrenberg said.

The Senate will receive the articles of impeachment from the House after the state work period, according to Chuck Schumer’s office. The senators are going to be in jury duty the next day. Senate President Pro Tempre will preside.

“This sham impeachment effort is another embarrassment for House Republicans,” he said. Speaker Johnson should be impeached because he wants to appease Donald Trump.

President Biden said that history will look kindly on House Republicans for the act of partisanship they had committed in targeting an honorable public servant.

Mayorkas is the first cabinet member to be impeached since William Belknap, Secretary of War under President Ulysses S. Grant, in 1876. It is highly unlikely that he will be convicted in the Senate or removed from office. Mia Ehrenberg, a DHS spokesperson, said in a statement that the impeachment was done “without a shred of evidence or legitimate Constitutional grounds.”
