It will now be up to the Manhattan district attorney, Alvin Bragg Jr., to launch a new trial against Weinstein. Donald Trump is being tried in New York on more than 30 charges of faking business records in the first degree, and Bragg is involved in that case as well. A spokesperson for the DA’s office told NPR Thursday in a written statement: “We will do everything in our power to retry this case, and remain steadfast in our commitment to survivors of sexual assault.”

On behalf of the appeals court majority, Judge Jenny Rivera wrote in part in the ruling: “We conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose… The only way the defense could win the case was if the court’s rulings weakened the accusers’ character before the jury.

Those women testified in court as “Molineux witnesses” or “prior bad act witnesses” — which has been allowed in New York in certain situations going back to 1900. Critics and legal experts say that application of the “Molineux Rule” can be highly subjective, and leaves verdicts more open to challenges.

There are a lot of drivers. Liu thinks it’s because there’s not enough work elsewhere, and he may be right. Last year China’s youth unemployment soared so high the government stopped publishing statistics. That is one sign the economy of the world’s second-largest has not recovered from the Pandemic in the way many of its people wanted.

One of the ways we’ve been looking at the economy is by speaking to delivery drivers, who are often on silent motorbikes and whiz through the streets delivering groceries, meals, clothes, water cooler tanks, and almost anything else. The pay is better than some other jobs — some drivers left their home villages to earn more in the city — though one driver, Liu Shiwei, said business isn’t good. As he ate a simple lunch of noodles and beer, he said orders were down, and too many drivers competed for them.

Steve Inskeep wrote the essay for Morning Edition and Up First. Steve was last in China five years ago and has noticed that it’s a lot different now. He’ll talk about his observations on Morning Edition today and in the days and weeks to come.
